Terms of Service
These Terms of Service ("Terms") govern your access to and use of the services provided by Exogus Web ("Exogus Web", "we", "us"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or 16 in the EU/UK) to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@exogus-web.site of any unauthorized use.
3. Acceptable Use
You agree NOT to use the Service to:
- Record or share content you do not have the right to capture (e.g., recording others without consent where required by law).
- Upload or share illegal, harmful, defamatory, or obscene content.
- Infringe on the intellectual property rights of others.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use the Service to send spam or unsolicited communications.
- Reverse engineer, decompile, or attempt to extract our source code.
4. Your Content
You retain all ownership rights to recordings and content you create using the Service. By uploading content, you grant Exogus Web a limited, non-exclusive license to store, process, and transmit your content solely to provide the Service to you.
You are solely responsible for ensuring you have all necessary rights and permissions to record and share any content you create.
5. Subscription and Payments
Paid plans are billed on a monthly or annual basis. All fees are in USD and are non-refundable except as required by law or as described in our refund policy. We reserve the right to change pricing with 30 days' notice. If you cancel, your access continues until the end of your current billing period.
6. Free Trial
We offer a 14-day free trial on all paid plans. No credit card is required to start. At the end of the trial, you must select a paid plan to continue using paid features.
7. Termination
You may terminate your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately and we may delete your content after 30 days.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCREENCAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the competent courts of Amsterdam, Netherlands.
11. Changes to Terms
We may modify these Terms at any time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
